The reason why Kyurem-Black was in Ou, not Uber, is because he couldn't use his Atk well. But now, not only he has icicle spear, he can also use dragon dance. And with dynamax, it is almost impossible to stop Black-Kyurem.

This isnt the place to discuss tiering/bans ect. For the National Dex format, were working on setting up some kind of council or something for it. Any sort of bans/mechanics decisions/ect will be handled by whatever is setup.
